Overview

Premises wishing to provide tables and chairs on pavements in Cherwell must hold a permission under the Highways Act 1980 or under The Business and Planning Act 2020, which allows applications to be determined within 14 days

Conditions

An application and annual fee are payable. Subject to compliance with our Street Trading Policy

The following details must be supplied:

  • the number of tables and chairs required
  • the times that the tables and chairs are to be used
  • the style of tables and chairs to be used.

What you need for this application form

The application form must be accompanied by:

  • Proof of Identity, and address and where applicable Right to Work. (see policy for acceptable forms of ID)
  • A map/street plan or aerial photograph clearly identifying the proposed site position
  • Photographs of the type of furniture to be used
  • Confirmation of the status of the site (ie highway, footpath etc.)
  • Details of neighbours, business or others within the immediate vicinity of the specified trading area
  • Original copy of the certificate of insurance covering for third party and public liability risks
  • Confirmation of other associated permissions i.e. planning and any appropriate licences under the Licensing Act 2003
Cost

Fees effective 1 April 2024

The fee is dependent upon the number of chairs in a 12 month period.

£18.70 per chair up to a maximum of 10 Chairs
